Welcome to Swoonly. Please read these terms carefully. By using the Service, you agree to these terms. If you do not agree, do not use the Service.

1. Service Description

  • Swoonly is an AI-powered virtual companion chat application. Users choose from preset characters for text conversations, and characters reply with voice.
  • All characters are AI-generated and not real people. You understand and accept that all conversations are generated by AI models, and we are not responsible for the accuracy, appropriateness, or completeness of AI-generated content.
  • Free users are limited to 50 messages per day. Paid subscribers enjoy unlimited chat during their subscription period.

2. User Accounts

  • You must be at least 13 years old to create an account.
  • You may register with email or sign in with a Google account.
  • You are responsible for all activity under your account, including AI conversation content.
  • Please keep your account credentials secure. Notify us immediately of any unauthorized use.
  • We reserve the right to suspend or terminate accounts for violation of these terms.

3. Acceptable Use

  • Use the Service to generate or disseminate illegal, pornographic, hateful, harassing, violent, or otherwise inappropriate content.
  • Attempt to reverse engineer, hack, or gain unauthorized access to any part of the Service.
  • Use automated tools (bots, scripts, etc.) to send bulk messages or create accounts.
  • Use the Service for any illegal purpose or activities that infringe on others' rights.
  • Impersonate others or fabricate relationships with individuals or organizations.
  • Violators will have their accounts suspended or permanently banned without refund of paid fees.

4. Intellectual Property

  • The Swoonly name, logo, interface design, and source code are our intellectual property. Do not copy or use without permission.
  • Character settings, avatar images, and system prompts are our original content.
  • AI-generated conversation content: You own your input content, but AI-generated replies belong to the Service. You may keep conversation records for personal, non-commercial use.

5. Payments & Subscriptions

  • Subscription fees are as displayed at the time of purchase and may vary by region.
  • All payments are securely processed by Stripe. We do not store your full payment details.
  • Subscriptions auto-renew by default unless you cancel before the current period ends.
  • Cancellation only stops future renewals. Current period fees are non-refundable unless required by applicable law.
  • We reserve the right to adjust subscription pricing. Price changes will be announced in advance and will not affect already-purchased subscription periods.

6. Disclaimer of Warranties

  • The Service is provided "as is" without any express or implied warranties.
  • We do not guarantee the Service will be uninterrupted, fully secure, or error-free.
  • AI-generated replies may contain inaccurate, inappropriate, or offensive content. You assume the risk of using AI replies.
  • We are not liable for service interruptions caused by network failures, maintenance, or force majeure events.

7. Limitation of Liability

  • To the maximum extent permitted by law, Swoonly and its operators shall not be liable for any indirect, incidental, special, or consequential damages arising from use of the Service.
  • Our total liability for any claim shall not exceed the total fees you paid to us in the 12 months preceding the claim.

8. Termination

  • You may stop using the Service and delete your account at any time.
  • We reserve the right to suspend or terminate accounts that violate these terms.
  • Upon termination, you lose access to your chat history. We may retain certain data as required by law for a limited period.

9. Changes to Terms

  • We may modify these terms. Material changes will be communicated via email or in-service notice.
  • Continued use of the Service after changes are posted constitutes acceptance of the new terms.

10. Governing Law

  • These terms are governed by applicable laws without regard to conflict of law principles.
  • Any disputes arising from the Service shall be resolved through friendly negotiation. If negotiation fails, the dispute shall be submitted to a court of competent jurisdiction.
